e Discovery Search: Enabling High Accuracy Every timeExecutive Summary
Validation testing of appliances, software and practices used in eDiscovery is not a common practice, but it should be. For too long, corporations have relied upon outside counsel, vendors and black-box technology without verifying their basic functionality, accuracy and completeness. Recent cases have made it clear that the judiciary holds corporate counsel and the corporations themselves equally responsible for meeting the standard of reasonable diligence. Your ESI has unique characteristics that can dramatically affect search accuracy and completeness. Comprehensive, accurate search capabilities are an integral part of analytics; without extensive and accurate search eDiscovery analytics cannot be performed in full. Unless you have run common discovery request scenarios on your own ESI, you could be unintentionally missing significant responsive items in searches. Corporations must have confidence in the technologies, processes and personnel that comply with discovery and regulatory requests. The purpose of this testing and report is to validate the search accuracy and defensibility for eDiscovery of the Kazeon Information Server on a large varied collection of corporate Electronically Stored Information (ESI). The Kazeon Information Server capabilities were impressive and exceeded reasonable acceptance criteria for consistent, accurate inventory, search, collection and export in legal hold and discovery scenarios. Even with the challenges of search comparisons on such a large corporate collection, the Kazeon Information Server and dtSearch, a search product used by numerous governmental and law enforcement agencies such as the Federal Bureau of Investigation and the United States Department of Justice, had a remarkable level of agreement on the results covering a wide variety of search types and sizes. The Kazeon Information Server search results averaged 103% of the dtSearch results and exceeded dtSearch on the Known Search Term testing. Overall, this level of comparative search testing gives the corporate custodian of record a strong and convincing argument that their chosen technology exceeds the legal standards of reasonable diligence. The following search accuracy and defensibility features were tested and verified:
Beyond the functional basics, the Kazeon Information Server inventory and indexing performance was excellent and the built-in exception workflow made remediating encrypted or password protected files effortless. The system collects hash and Operating System metadata during inventory, which enhances the authentication and Chain of Custody documentation for productions. The multiple deployment and licensing options give corporations implementation options ranging from immediate coverage of a single case all the way to use as the standardized eDiscovery platform. Further, Kazeon’s software can be used in conjunction with archive software (e.g., Symantec Enterprise Vault) to enable corporations to get an enterprise-wide coverage for eDiscovery.
